Legal Question in DUI Law in Pennsylvania

First Offense-D.U.I. Underage

I am 19 years old, and was just

charged with my first D.U.I. offense.

How likely is it that I will qualify for

the A.R.D. program? Is this a timely

process, I am planning on studying

in Argentina for 4 months starting 2

months from now. How much fines

can I expect to pay? What about

higher insurance? It was in a van

registered to my father

Fines and costs vary by county and range around $1000-$1300. Since there is no conviction there should be no insurance increase unless there was an accident involved. You should speak with an attorney to review your eligibility. I offer free initial consultations.

You probably qualify for A.R.D. since this is a first offense. If you go the route of A.R.D. you want to make sure to make arrangements regarding probation that take your plans to leave the country into account. You may also want to consider defending the case at least at the Preliminary Hearing stage.

You will be eligible for ARD as long as you are not charged with: reckless driving, accident involving injury or death, fleeing & eluding police, if a child (less than 14) was in the car with you at the time. This is not an exhaustive list of offenses that statutorily prohibit you from receiving ARD. Because you may have problems, because you are going out of the country, and because this is a serious matter you should have the advice of an experienced attorney to make sure all goes as smoothly as possible.
