Legal Question in DUI Law in Pennsylvania
Pa Dui & Interlock
I was convicted of a 2nd Dui in early 2004.I fulfuilled all requirements. Due to an unrelated illness/injury I did not bother w/getting my license restored & have not drove in almost 5yrs. Since I have gone way over the 2yrs license suspension & year interlock requirement will I still be required to have interlock? If so, since I don't own a car, if I certify such, can I forgo interlock and choose to remain without a license & not drive for another year? Can that be back dated for the past year? If not, After that year is over (withouth interlock/without any license) will I be able to get my regular license restored?

Re: Pa Dui & Interlock
you cannot back date or get time credit for the passing of time to usurp the interlock device. the fact that you don't own a car may allow you to get around the requirement--i don't know the answer.
if you are able to get a license without the interlock, just don't drive until the interlock requirement passes. if you get picked up driving without it, you will go to jail.
also, the interlock is a GOOD thing. you want it.
