Legal Question in DUI Law in Pennsylvania

Pa DUI Laws

Boyfriend was arrested for DUI in PA. first offence was in 97in OH, second offence in 01 in OH. Will these other 2 offences count against him in PA law? The first one being so long ago, will it still count against him?

As already stated, it is either a second offense or third. The date the ten year period begins to run on the 97 arrest may not be the date of arrest either, it may be the date that the matter was resolved. Try to find the relevant dates for the 1997 DUI before you contact an attorney, as they will need this. If you want to talk more about this, feel free to contact me. It is either a 2nd or third. PA has a 10 year look back period and PA does count other states' DUI for sentencing purposes. Therefore the question is when were you convicted of DUI? Was it more then 10 years before the arrest in the current case?

2001 was not that long ago, but as to the 97 one, your state has a specific timeline (probably 10 years) where they will look.
