Legal Question in DUI Law in Pennsylvania

PA resident refuses breathalyzer in CO.

If my license is revoked in Colorado

secondary to a refusal (express

consent), will my liscense in PA

automatically get suspended for the

same time period through the DMV

regardless of the criminal outcome?

And if so, what chance do I have to

get an occupational limited license?

(I'm a professional). Thanks.

Re: PA resident refuses breathalyzer in CO.

If you need your vehicle for work you can apply for an occupational limited license but the requirements are very specific. You license is either a Colorado or a PA license. You can't have licenses in both states. I'm not sure about Colorado, but the refusal is enough to suspend the PA license. You can fight the suspension and you should be getting notice from PennDOT of your rights with the notice of suspension if this is a PA license.

Please feel free to call my office or send an e-mail with further details and your number and I'll be glad to talk to you about this.
