Pass a field sobriety can they give breathalyzer

My boyfriend and I left the bar in seperate cars an officer followed us when he pulled my boyfriend over 8 miles later he stated that he ran 3 stop signs. The last stop sign was 5 miles behind us. He then requested a field sobriety test that he passed and then took a breathalyzer. He blew a .098. Do we have a chance to fight this!

Yes. Email me back and let me know...is this a first DUI? Were there any other traffic violations w/in the 5 miles? What field sobriety tests were given? How do you know they were passed? And, where are you located?
