Passanger in a DUI
I was a passanger in a car when the driver got stopped and got a DUI. I was 20 years old and intoxicated. I was cited with Underage, Public Drunkedness, and disorderly conduct. I did not cause a scene and only stepped out of the vehicle when ordered. Now I already have 2 DUIs(within a month of eachother .15 and .04) and driving under a DUI suspended license on my record all this in Montgomery County, PA. At this moment I am serving 90 days in jail for the driving with a suspended license. This underage happen 11 days before I was to turn myself in for the jail sentence. I know I probably have no chance of sympathy but when I go in front of the same District Judge for the 4th time in 2 1/2 years what can I say to him to convince him to drop some of the charges? Or is there any other roads I can go to get this snowball to stop rolling downhill?

The fact that you were ordered out of the vehicle removes the voluntary action requirement of the disorderly conduct citation. Additionaly, the officer may not have had probable cause to perform a blood alcohol test. You need to speak to an attorney to review your case in further detail. I offer free consultations.
