Passenger DUI

Are there any provisions that include the passenger receiving a charge(not open container) due to the driver and passenger being impaired?

I don't understand the question. Are you asking if they can charge a passenger for being impaired the answer is yes, they can charge him for public intoxication and maybe some other things depending on the circumstances but they are unlikely to win.
