preliminary hearing

I have been suboena to testify against my sister. What happens at the preliminary hearing and could she go to jail from there?

Preliminary hearing is to determine what evidence the Commonwealth has against the defendant, not to put on a defense. Your sister should get an attorney. It is possible, but not likely, that your sister would go to jail from the preliminary hearing on a DUI charge. The District Judge can set bail at this hearing, or release her on her own recognizance.

Your sister needs a lawyer. While she can't be convicted at the preliminary hearing, evidence can be tested by an attorney to see if the prosecution has a case. Her attorney could then advise you on how to respond to the subpeona. I offer free consultations.
