Legal Question in DUI Law in Pennsylvania

Probable Cause/DUI

Recently I was in the car with someone who in turn got a DUI. But the police officer said we were pulled over because we had our high beams on for a few minutes. This was due to the area being heavily wooded and hard to see. He followed us about 2 miles or so until he pulled us over. Is that probable cause enough in PA to get pulled over? Or is that something that could throw the case out. Thanks.

Is that what the ticket says? What does the ticket say? You can attack the reason for being pulled over, and yes, if successful, you can get the case thrown out, but the court will do everything it can to find in favor of the cop. It sounds to me as if there is a good argument that the results of the stop should be suppressed. Was there any traffic violation? Your friend should get a good local attorney.

It would be against the law only if there were cars coming in the other direction while the high beams were on.
