Legal Question in DUI Law in Pennsylvania
got pulled over for my lights being out. furthermore, i was breathalized and taken through a sobriety test.Which resulted in me blowing under the legal limit. my citation says the fine is $25 and the costs/fees are $86 resulting in $110. Do I have to pay the costs/fees value since i was driving legally?

Question answered by attorney Michael Kotik of Philadelphia, Pennsylvania:
In order to fully answer your question, I would first need to know exactly the description of the citation that was given to you. In other words the code that corresponds to the fine. If the citation was something with respect to having your lights out you would have to pay it, because a traffic citation is going to be different from the DUI charge. In your case you broke some traffic law that allowed the police officer to pull you over. After he pulls you over every thing that you do, the contraband in the car, whether your drunk or not, all of that can result in additional criminal charges, which would be separate from the reason he pulled you over.
