Legal Question in DUI Law in Pennsylvania
i was in a single car accident where i blacked out behind the wheel and swerved back and forth on the road til i flipped my car in a ditch....when i awoke i got out of the car and 5 min. later a police officer arrived....after being checked out i was taken into custody for DUI no field sobriety tests or blood was taken on the scene and officer never saw me behind the wheel...what are my chances of beating this ? A witness saw the accident but did not stop and it was between 130am and 230 am the accident occured..do i have a fighting chance in this?

If this is a first offense, you may be eligible for ARD which will enable you to minimize your license suspension and have the record eventually expunged...Did you have a blood test or brat test AFTERWARD within a reasonable time. Hopefully you did not refuse....
