Legal Question in DUI Law in Pennsylvania
my son had an accident
He's charged with s75 3802 dui
s18 6308 purchetc alco bev by a minor
s75 s3309 disregard traffic lane
s75 careless driving he drank the whole night before at a frat party at Indiana Univ.-- he was driving the next day and admitted that he had drank the whole night before-
but it was raining and he slid through a fence and nicked a house- ( my friends) no charges here- already had an underage drinking charge 2 yrs ago and lost license for 90 days- the cop was taking him for a blood test- which he didn't want to do because trooper told him all alcohol taken in previous 48 hrs would show- he admitted to drinking earlier- asked if he had to have blood drawn and cop said no- he would loose license for 1 year- he said he would loose license for a year anyways because he would show alcohol in blood since he was under 21- he was confused on issues- magistrate hearing on 10-9-07- do I really need to get him a lawyer when he is going to plead guilty as he had alcohol in his system from previous party-- please advise- extremely upset- he is a very good child- a & b's works and studies hard-- is it a clear cut case since he's under 21??

A lawyer might be able to get your son ARD which would avoid a misdemeanor conviction on his record. Additionally a lawyer may find technical defects in the case which could lead to an acquital. I offer free initial consultations.
