Legal Question in DUI Law in Pennsylvania

Our son is a freshman student at University in Pennsylvania. As a freshman he is not allowed a car. He borrowed a friends car (with permission - several friends had been driving this car throughout the day). He hit another car while parking in a fast-food parking lot. The other car was owned by a student at the same University. The fast-food store called the police, and the police issued our son with a DUI charge. The father who's son lent our son the car is asking me to pay for the repairs to his son's car. This father told me he has had a collection letter from the other insurance company for the repair to the other car, and his insurance company are refusing to pay it. What do you advice me to do? Who is liable to pay for the costs of repairing each vehicle?

There are several levels to the problem...

I assume your son made admissions to the officer, so it appears he will lose his driving privilege in PA and NJ.

If the insurance co is refusing to pay for the damages, there must be some question about whether your son was allowed to drive the vehicle, which cold lead to an "unauthorized use of motor vehicle" charge to come.

Generally, I would advise anyone in this situation to consult an attorney as this thing looks like it is quickly getting out of hand.

Right now, I don't have enough info to determine "fault" in the accident. The other party can request their deductibles be paid, and it could get wo4rse from there....

Please feel free to contact my office. I've been defending these types of cases for almost 20 years.
