Underage and Criminal Mischief

I am a registered driver in the state of pennsylvania. The accident occured in PA. I am currently living in NJ for the summer. During the school year i live in state college, PA. I was at a party in Newfoundland, PA in Wayne County. The following morning at 9 a.m. or so a friend had asked to borrow my car. I was still intoxicated. I wasn�t able to tell if she still was, but she said she was ok to drive & i gave her my keys. She wanted to take her friend to work. She has a legal PA license. I was sleeping in the back seat. She ran a stop sign at an intersection. She hit an embankment across the road & a car driving through the intersection had hit us in also. Cops had come to the scene of the accident, told us we were drunk, were both going to receive an underage & the driver would also receive a DUI. The cop was an asshole to be blunt. Is it smarter for me to the accept the penalty or should i fight it? Where do i stand in the matter of legal for both sides. I wasn't breathalized at the scene nor did I give any blood. The cop had told me if I choose to fight it he would bring everyone back from the scene to court to say I was legally drunk. Please guide me in the right direction.

You may be elligible for ARD. Under the ARD program, you are put on probation and if you don't committ another offense the charge is dropped and your record expunged. I suggest contacting an attorney to disucss this and other options. I offer free consultations.
