Legal Question in DUI Law in Pennsylvania

Underage Drinking Citation

I recently was stopped by police with two of my friends tailgating at a concert venue. We had literally just pulled up and my two friends had each opened beers. The police came took the case of beer and proceeded to search my car and everything in it without asking permission. The male officer also proceeded to pat down both myself and my female friend. My friend had a small amount of marijuana on him. Right before he left he said there is a possibility this could get thrown out, so now I'm nervous waiting to hear from them. How long could it take to process? Also, I am a full-time student living far from home and heavily dependant on a car, I am 20 years old and it is my first offense, is there a way if i did receive the underage not to lose my license? I do not want to necessarily fight the underage because the officer threatened if we did fight it drug charges would be added.

Re: Underage Drinking Citation

It's hard to answer your question without knowing what you are being charged with, what county this happened in, and a little more information about the incident itself. When you are charged, feel free to email me and I will be happy to provide a some insight.

Re: Underage Drinking Citation

It all depends on what you were charged with. If you are underage and charged with DUI, then you have to defend these charges, because the penalties are very tough. Without seeing the charges, I cannot say for sure. You can e-mail the documentation to me at [email protected] or fax at 215.689.4375. I'll take a look at it and tell you what your options are. Do not just show up and give in--the penalties could be very serious.
