Legal Question in DUI Law in Pennsylvania

underage drinking

My son has a citation for underage drinking (not driving) in PA which automatically suspends driver's license for 90 days. However, we live in VA. Will he still lose his license for 90 days even though we are out of state?

Re: underage drinking

Unless Virginia suspends licenses for the same reason, provided he has a Virginia license the answer is no. He won't lose his license. I know this because I recently had a case where this arose. The civil license suspension penalty applies in the state where the person has his or her license.

Yes. I advise getting him a local attorney (what county are the charges) who can try to downgrade the offense.

Re: underage drinking

Pennsylvania and Virginia both participate in something called the Mid-Atlantic Interstate Driver's License Compact which supposedly shares information among or between member states regarding convictions of drivers in one state who may be licensed in another.

This system, however, being part of state bureaucracies, is not infallible and sometimes information is not shared as intended, and if such

occurs with your son's situation, his license may not be suspended in the Commonwealth.

He, of course, however, should not count on it.
