Legal Question in DUI Law in Pennsylvania

Underage

My question is regarding underage drinking. Thursday I recieved my third underage drinking citation. The resident assistants of the dorm came into my friends room where I was and gave me a citation. I did not have alcohol on me. They had also found my cell phone on a different floor where I dropped it and where using it to call my friends asking where I was, assuming that I was drunk. Anyway its policy at my University to take students to the hospital. At the hospital they did not take my blood. Considering it is my third underage drinking citation would it be in my best interest to testify not guilty since they didnt take my blood although I was obviously drunk. Or should I just suck it up and take the consequences, if so what would they be? Also I heard sometimes they drop it down to a lower charge, how could I make this happen? Thanks.

While they may be able to testify as to your appearance and how you acted, the fact they didn't get a blood test may give you some leverage to get a reduced charge, such as disorderly conduct. I would suggest you get an attorney. I offer free consultations.
