Legal Question in DUI Law in Pennsylvania

Will DUI carry over?

I am being charged with driving intoxicated in PA. I have 2 prior convictions in Ohio. Will these carry over, or will this be a ''first offence''?

Re: Will DUI carry over?

YES...if the other DUI or DWIs occurred within the past 10 years...my website has specific information on this topic that will give you a better idea of what to expect.

I do recommend that you immediately retain counsel on this matter, failure to do so will significantly derail your defense!

My office also offers flat rate pricing and free consultations, for additional information please visit my firm's website at www.AlleghenyAttorneys.com or by calling my office at 412.731.0865.

Re: Will DUI carry over?

Under the statute offenses in other jurisdictions do count if conviction or other form of preliminary disposition was within ten years. A third offense DUI carries a mandatory minimum sentence which varies based on blood alcohol level .08 - 10 days(Max 2 years),.10 -90 days(Max 5 years) ,.16 or refusal - 1 year (Max 5 years). I highly recomend speaking with an attorney as soon as possible to explore possible defenses that you may have. I offer free consultations.

Re: Will DUI carry over?

Yes, they will "carry over" if they were within the last ten years. DUIs can often be successfully defended, given the right set of facts. You should call an attorney as soon as possible to determine if you have a valid defense to this charge. There is mandatory jail time for a third time DUI.

I would be happy to speak with you about this matter.
