Legal Question in Elder Law in Pennsylvania

annuities and nursing homes ''look back'' period

I am interested in information about what assets, i.e annuities, that a Nursing Home can legally claim when a person needs care. Do annuities qualify in the 3 year look back period?? thanks

Re: annuities and nursing homes ''look back'' period

Excellent question and there is no way to answer all of it here. The lookback period is 36 months on everything and 5 years on trusts. Some annuities if done properly will protect an asset but most will not. The restricitons and penalties on this get tougher every year.

There are still good ideas that will allow you to protect assets especially if their is non-institutionalized spouse.

My office offers a no cost intital consultation and we can go into the greater details of medicare and estate planning.
