Legal Question in Elder Law in Pennsylvania
Hello, I'm my elderly mother's durable POA, medical proxy and authorized rep for SSI & social service benefits in LI, NY. My mom , also legally resides with me & I'm her caregiver. I moved to LI recently and left my mother in another relatives care. My mother's other daughter came and took my mother to Scranton, PA without my permission. There have been a series of events by this person trying to harm me /block me from getting my mom which are all financially motivated. I finally traveled to PA 2 days ago and requested a police escort to go get my Mom. When we arrived she stuck her head out the door and the slammed the door in the officer's face. The officer advised me to get an order and have the sherrif come to get my mom so I can take her home. My mother is due for medical follow-up appt. She has Alzheimer's, kidney disease and a pacemaker. I'm responsible for her and healthcare. I'm not sure if I should go to a court in NY or in Scranton, PA where my mom is being held as a hostage by this person for self-serving purposes. What court do I need to go to for an order? Unfortunately this is a common situation and you will have to go forward with a Guardianship proceeding in the Pennsylvania County where your mom and sister are living.
