Legal Question in Elder Law in Pennsylvania
Gift of money given by elder
My grandmother is in a nursing home. My brother has power of attorney. How much money can be given as a gift per year to my grandmother's relatives?
We don--name removed--want the nursing home to get all of her money, nor does she. However, we want to make sure that any transaction is legal.

First off there is a 5 year lookback period, meaning any transfer of money from your Grandmother for the purpose of having Medicare and Medicaid pick up the tab for the nursing home would be considered null and void.
