Legal Question in Elder Law in Pennsylvania

guardianship laws in PA

Hi. My mom has mid-stage Alzheimers. My nephew and daughter live with her. I beleive that my neice, who does not live there anymore, is using my mother's SS# to get credit cards and purchase a house(mom as co-signer). I want to get guardianship so that I may look into this for my mother and protect her interest and to see that she is being properly cared for. I also want to find out who her lawyer is to get things in order, but my nephew will not tell me. I know that he has had my mother sign some papers, but I do not know what they were. Will the guardianship allow me to check into all of this? Also, what are some of the basic laws of guardianship in PA.

A guardianship of the person and estate would allow an individual to handle financial and leagl decisions concerning an incompetant individual. A physican preferably one who treats the alleged incompetant would be necessary to certify that the person is in fact unable to handle his or her affiars. A petition would have to be filed in the common pleas court where your mother resides and notice sent to all interested parties so that they can determine whether they desire to contest the petition or person seeking to be appointed guardian.
