legal guardianship
If I take legal guardianship of my mom over my brothers POA would I be responsible for any of his mistakes he made by misuseing her funds?

No. Just make sure you transfer all of mom's existing accounts into brand new accounts so you have a starting place of exactly how much money you started with when you took over.

You asked about liability for prior misuse of funds if you take legal guardianship.
No, you will not assume liability for the bad acts of others.
But, as guardian you would have the right (and some would say obligation) to pursue the bad actor(s) for the prior bad acts.
You need to speak with an attorney practicing in the area of elder law. This person can guide you on the best course of action to protect you and your family and to obtain what is due.
