Legal Question in Elder Law in Pennsylvania

Locate missing? mother

Help! this is complex: the people involved are my 78 year old mother and her 53 year old husband. Seven years ago, mother and her then foreign paramour (now husband) were responsible for my fathers death. An altercation happened, and father died at the scene (heart failure). Police did nothing. No wrongful death suits made by children against mother & paramour. Relationship between mother and children became estranged. Mother married paramour. Mother tried to divorce new husband and after a few years, hired an attorney, filed abuse, divorce proceedings, drew up a new will, and appointed brother POA. Also, attorney got her property back because new husband had his name on the deed. Mothers health deteriorates(dementia). Mother lets husband back in, does not follow through with divorce. Husband is using her social security benefits and assets for his own use. PI found no bank or credit history on foreign national. Name is again back on the deed. Property has now been sold. No word to family members regarding the sudden move. Mother was also treated at hospital due to fall. No one was notified. Now we do not know where they moved to and phone is unlisted. Missing? What rights does a spouse have when POA was given to brother?

Re: Locate missing? mother

You need to get an attorney in the general area where your mother lived, possibly the attorney who was assisting her with the divorce. I would suggest that you do this right away. This may be a case of elder financial(or possibly even physical) abuse, but you need someone from the state where your mother lives to assist you.

The person with the POA does have the power to get information about the sale of the house from whoever handled it (title company, real estate agent).
