Legal Question in Entertainment Law in Pennsylvania
Do I need permission for image use
Hi,
I am making a video for retail sale in stores. In it I have a shot of an icecream truck. I got permission to use the photo of the truck but I was wondering if I need to get permission from the ice cream companies whose stickers appear on the truck:
There is a Sponge Bob icecream treat - sticker on the truck, as well as a Spiderman icecream treat - sticker on the truck.
Good humor sticker is also on there.
thanks,
Dan

Re: Do I need permission for image use
It depends. While I can often answer general questions on-line I can't provide a satisfactory answer without a thorough review of the media, a description of the intented and likely audience(s) and marketing channels and possibly some significant study on this matter.
This service is a means for people to figure out if they need a lawyer or not. In most of the questions I've seen through LawGuru the matters are handled with a simple explanation of the law and a quick answer. Here, a simple explanation of the law isn't available and won't help. Nor is there a quick answer avalable other than the first two words in this response.
If you'd like to discuss this matter further you can contact me at [email protected]. Or you may find an attorney through other means. You are correct to look at this matter further, please follow up either with myself or another attorney.
