Who gets custody of the child is based on what would be in the best interests of the child. The child's mother and father have standing. Your parents, if the child has been with them, may also have standing.

First question where is the baby's father?

The court will grant custody based on who can care and provide for the child. Also, if the matter is brought before the court your parents will have an attorney. Therefore, you need one as well. The court is only going to grant you custody if it sees based in the evidence presented

that you have a home and some way of supporting yourself and your child. Is father paying child support? If not and you could get a support order is father going to actually pay and based on his income how much support will there be?
