I have 5 year old son. I was never married to his father. I need to move out of state to help my mother who has been sick. Can my child's father stop me or keep me from leaving the state?

The proper procedure is to petition the family court for permission to move the child with you out of state.

To be able to move out of PA, there are strict requirements that must be followed. First, a notice must be sent to him and the notice must comply with the statute. If he consents or fails to respond, then you can proceed with the relocation petition and the court should grant the petition. If he does not consent and he files a counter-affidavit, then a hearing will be scheduled where the court will look at a number of factors to determine whether it is in the child's best interest or not to relocate.
