Legal Question in Family Law in Pennsylvania

I'm active duty military stationed in Germany. I'd like to file for divorce in my home of record state, Pennsylvania, but I obviously can't physically live there right now for six months prior to filing. Will the courts waive that portion of the residency requirement for AD service members?

That's not the only thing that would have to be waived. You would have to waive your rights under the Service Members Relief Act.

First, see if you can get a JAG officer to talk to you about your rights under the act. As for residency if you claim that your non-military home is Pennsylvania that may solve that issue.

If you have any questions feel free to contact me. The initial consultation is free.
