adoption

i'm married and have a son from a previous relationship. my husband wants to adopt. real father lives in michigan, never seen child, not on birth certificate, and rarely pays child support. is it possible to adopt without having real father sign over?

No. You must obtain a voluntary or involuntary termination of parental rights. In cases such as the one you describe, this is often possible. He may be willing to do so in exchange for termination of his child support obligation. ON the other hand, the court may order the termination as being in your son's best interest (if he refuses).

No. He can either voluntarily terminate his rights or you can ask a court to involuntarily terminate his parental rights.

If you have a choice voluntary is the way to go. I think if you point out that by signing away his rights he will not have to pay child support he'll be more than willing to sign.
