Assuming the biological parents voluntarily terminate their parental rights they may at the termination hearing withdraw their consent. If either or both of them do that then there will be a hearing to see if that parent(s) rights should be terminated. The level of proof required is clear and convincing evidence. A higher standard then preponderance of evidence. Should the court terminate their parental rights they have 30 days to appeal.
