My son has not seen his father in 3 years. when he was born the father refused to have his name put on the birth certificate, 3 years ago we went to court for child support and a paternity test was done. At this point there still isnt a name on the birth certificate, and I am involved with a man who would like to adopt my son. I am not sure how to begin this process, and I am interested in doing it without the father be involved.

Step 1: Get married to the man you're involved with. Otherwise your parental rights will have to be terminated as well. That sort of happens when the man is your husband but as his wife you are a party to the adoption and are adopting your child as the second parent.

In either case you will have to terminate the child's father's parental rights as he has been found to be the child's biological father.

The good news is as a result of the adoption the biological father will no long be obligated to pay child support. So he will have incentive to sign voluntary termination papers.
