Adoption

My son is inquiring about adopting his girlfriends son who is 4 years old....they are not married and we were wondering if he could still adopt her eldest child without being married to his mother. The natural father is willing to give up his rights.

Yes he could BUT then the Mother would have to give up her parental rights.

If however, he were to adopt the child once they were married then even though technically mom gives up her parental rights she gets them right back as his wife.

One question would be if she's willing to make him the father of her child why not marry him?
