Legal Question in Family Law in Pennsylvania
Alcoholic sibling losing it all...
My brother is an alcoholic. He has lost it all except his house and about to lose that. We know his home is worth$160,000 for the land alone. The realtor is acting so nice of course. Recently said they want to personally help him so has made a plan (while he's so intoxicated) that he'll (the realtor)will ''volunteer'' to buy the home from him or have a realative of his for $60,000. My brother is so desperate and believes he's talking to a nice person. We as family know he's being ripped off. Is there anyway we can do to make sure all transactions for my brother be co-signed? He would not volunteer to have us do that but he is mentally unstable, people are talking to him while so drunk he can't even stand and making him sign things. He's been in rehabs and signed himself out. I know it's his life but isn't there something family can do when the world is taking advantage and basically stealing $100,000 from him and he doesn't know it....what can we do, where do we go, is it a hard, long, expensive process and could it be in time to stop the house sale. Thank you for your time...

You may be able to petition the Court to appoint a guardian for his finances. Obviously if he is competent he can sell his property for whatever he wants to. If he is not, then someone should be making decisions like this for him.

I agree long term a guardian needs to be appointed. In the short term contracts are voidable if the person signing them is intoxicated. Especially if the other party knows he's intoxicated.
