Legal Question in Family Law in Pennsylvania
alimony and cohabitation
I have been divorced for 2 1/2 years and paying $400 per week in alimony for 5 years total. My divorce was in the state of Pa. In my divorce decree there is no mention of remarriage or cohabitation as breaking the agrrement. Is this an implied law? Also my divorce has a non modification clause, will that effect my termination of payments because my ex wife has been cohabitating? Finally my ex wife has had a man renting a room in her house paying her $600 per month rent. Is this considered cohabitation in Pa. or do they also have to be having a sexual relationship?
thanks
John

Re: alimony and cohabitation
The judge defined cohabitation as living together and doing it.
Yes remarriage or cohabitation may terminate alimony if the agreement cites the appropriate Pennsylvania statute.
