Alimony Modification

Further question to Mr. Davidson: I'm looking for an attorney to handle this case : The basis of the alimony was agreed upon in the property settlement agreement and not merged into the divorce decree - does that make a difference. Opposing side is saying the court cannot have jurisdication over alimony since the specific word ''modification'' was not used in this contract.
