asked to leave

my wife has fied for divorce in philadelphia pa. we rent our home she wants me to leave now but i have no where to go yet. our lease is up on sept. 1st, 2006 can i stay there until then since both of our names are on the lease.or must i go now. it mite take me a little time to find a place can she kick me out now.. please respond asap. thank you so very much.......

First rule of divorce don't be the one to leave.

Because your name is on the lease you have the right to the quiet enjoyment of the apartment as does your wife. While she can petition the court to have exclusive use of the marital residence its unlikely, unless she can prove having you around is dangerous, that she'll get such relief.

Further since your name is on the lease you're on the hook for the rent. So if you have pay you might as well stay.
