Legal Question in Family Law in Pennsylvania

my brother in law lives in PA has full custody of kids 15 & 8. Due to wife's drug problems she lost custody. He also a drinking problem and now has lost job and home. He called his parents and told them hi is homeless. They have booked him a hotel. They live in AZ so they are on their way to pick him and kids up and take them to AZ. Can they remove kids from state? I don't want to see them get into trouble over this. Should they contact domestic relations or a lawyer? thanks

It depends on the language of any court order or custody agreement between the parents. Nowadays, most states have procedures dealing with the relocation of children.

Pennsylvania just enacted sweeping changes to relocation procedures in January 2011, so YES - your brother-in-law (or someone in the family) must consult with a Pennsylvania attorney ASAP.

If you'd like to discuss your brother's case offsite, feel free to contact me. Best of luck to your family.
