Legal Question in Family Law in Pennsylvania

My brother is going throught a divorce, When him and his wife were still together he wrote a check out form her credit card to pay a car payment for a car they own, She said it was ok and they were paying on it. Now that they are not together she is taking him to court and he could be facing a felony charge and jail time. Do you think anything will come of this since they were married at the time it happen or will he go to jail.

Who is representing him in the divorce...and is the same lawyer handling the criminal matter?
