burned for the last time

Hello, My name is--name removed-- My husband and my teen child have not been getting along he gave me a chose its either him or my child. Since two weeks my child has been staying with my sister. My husband has been acting like nothing is wrong because my other child (not his) is still here with him in a home I purchased and any and all paper work is in my name. He won't leave and he has told me he won't give me a divorce because this is unfair to our child we had together. I have not eaten nor have I slept in over two weeks. Since he won't go I have decided to try and go and move to a new home. Except one problem. THe mortgage and loan are in my name only and I don't know how to go about getting this transfered from my name. Please inform me as soon as possible. Thank you

One option would be to file the divorce, serve it on him, and request in the divorce that you have exclusive possession of the marital residence pending the divorce and that HE has to leave. In either event, if you leave, he would be responisble for the bills associated with the house-mortgage, etc...if he did not pay, then you would again have the option of going to court to either get him out or force him to pay.

You need to speak with a lawyer. There are many ways to get people out of homes incuding PFA's, spousal support orders, etc. Deciding to leave a marriage is a difficult decision and professional advice about the logisitics is extremely helpful. I offer free consultations.
