buying a home while separated..

I've been separated since October 2001, I have not obtain a legal divorce, i want to know if i can purchase a home till i can get a divorce and am curious if she can take possesion of home? The home will be a joint mortgage between another person and I.

Marital property is defined as property acquired from the date of marriage to the date of separation. If this property is being puchased with non-marital assest such as income earned post separation, it will not be part of the marital estate. However, you will need to show the nature of the purchase price so keep your records.
