Can I change my nephews last name to mine? His father has gave up his rights and I do have legal custody of him,

You should be able to. Bring any custody documents along with proper identification to the court of common pleas in your area. They should be able to direct you as to which specific forms you will need to fill out and inform you of any associated fees.

Did you adopt the child? If not, the father cannot simply give up his rights. Does the mother also agree? You would need to file the propert petitions and serve the parents with notice of the hearing. There are other procedures to follow as well.
