Legal Question in Family Law in Pennsylvania

Name Change

My wife's birth certificate has her surname as that of her birth father. He left when she was an infant and her mother remarried. She then started using her step-father's name enen though she was not adopted. When we married the marriage license was issued using her step-father's last name, which we were assured was ok as my wife had a social security card in that name, got paid by that name and paid income taxes under that name. Just recently we had occasion to present both her birth certificate and marriage certificate as document proof to renew her NJ driver's license. We were informed that we couldnot use these documents as the names were different and she should get her birth name changed to her step-father's name even though she now uses my last name as her married name. We were also informed by our State Representative's office that we should do this as it could present problems down the road re Medicare or Medicaid. Basically, my question is this - are they right and is it possible to change your maiden name? At this point we are thoroughly confused and would appreciate any advice we may receive.

It is possible to change names by Petitioning the court so long as there is no fraudulent purpose. It is also possible to Petition to correct records. I believe you should consult with an attorney in your area to investigate the possible options in addressing your problem.
