Legal Question in Family Law in Pennsylvania

I divorced my ex in 1998. I stupidly just went for a simple no fault divorce. Money was a problem but I needed to separate from him. We have 2 children he never really paid child support. I would tell him I was going to take him to court and every few months he would send $100 to put me off. He met someone and before he got married in 2006 we agreed to sign a support agreement for $125 a month until my youngest turned 18 (she was 14 at the time and my son was 17). I also signed my rights away to his very valuable profit sharing account (I forgot about it). It is now 2007 and he is 4 months behind on child support. I have no court order and the paper he had drawn up states I won't take him to Domestic Relations Court. I am in such a bind. He never wants to pay. I can't afford a lawyer. I am also remarried. Can I do anything? Please help. I live in PA. I only work part time because I have another little one. Any advice would be great!

You asked about support payments.

The paper he had drawn up likely has no validity. Child support is for the benefit of offspring of the non-custodial parent. It is only because the children are minors that the payment is made to the custodial parent.

You should speak with a local family law clinic that can help you with your situation. Irrespective of the agreement you may be able to look back for retroactive child support. A family law clinic may be able to help you without charge or direct you to local counsel that can assist at low or no cost.
