Child Abandonment/Legal Name Change

I was curious the length of time that must pass before you can consider child abandonment? My ex-husband hasn't seen them in almost 6 months. I am not receiving child support either. I know you have to petition the court to have the child's name changed. Is it still necessary to petition the court if it is considered abandonment?

In order for a parent's rights to be terminated there must be another parent to fill the shoes. Six months is not enough time to say the father has abandoned the children. For further detail, please contact an attorney.
