Can I as a Canadian Citizen and permanent resident Divorce my husband and move my child back to Canada. He has no family is divorce with obligations to children from previous marriage and I have an extensive family and support structure in Canada

You asked about child custody and returning to Canada with a child.

This is specifically a situation that will need to be considered by a court. There is a possibility that the court will allow a child to be relocated out of the country as long as it is in the best interest of the child. The other parent will have a large say in the custody as long it can't be shown that s/he is an unfit parent.

Your best bet is to hire an attorney and work the matter out amicably. A court will be very unlikely to allow a child to be taken out of the country if the relocating parent will not make it easy for the remaining parent to have a role in the child's life. This may include you having to promise to send the child back to the locality XX times per year for visitation at your expense.
