Legal Question in Family Law in Pennsylvania

child custody

I am dating a woman with an eight year old child. I have a felony record from 13 years ago (burglary). Is it possible that I am putting her in jepordy regarding custody of her child? I am concerned that if her ex-husband were to realize the mistakes of my past with me sharing a home with her I could cost her in ways I never considered reagarding her standing with the courts.

You asked about a custody issue.

Generally, crimes more than ten years old and without violent or moral components are very difficult to make an issue after 10 years have elapsed. Even in another criminal matter a prosecutor would generally, by law, be prevented from introducing such matters, even if you were charged with the same crime.

In custody matters judicial officers have a little more latitude but the plaintiff would need to demonstrate a very significant junction between the crime and best interest of the child. It probably doesn't exist here.

Good on you for thinking of this matter proactively. Keep your nose clean, your head high and get on with your life. We all makes mistakes, just not everybody gets caught.
