Child Custody

my daughter is on parole. she was just sent to a rehab for a drug violation. she had not been coming home for more than a few hours each day. she just left her 2 kids ( 1&2YRS)with me to take care of. Can I release them to there father if he is going to take them to another state? there are no custody papers between them.

You may be required to. If he did not have his parental rights terminated and he has been an active parent then he has as much right to custody of the children as the mother. It would be up to her to assert her rights as the mother to stop him from taking custody of the children.
