Legal Question in Family Law in Pennsylvania

Child Custody and Disability

Hello,

I have a question. My ex husband is threatening to take me to court for sole custody of our child. I am a good mother and a good person. I have no bad habits such as alcohol or smoking and I do not, of course, do drugs.

However, I do receive disability. My disability doesn't nor has it prevented me every fromm caring for my child. However, my income is very low. I do receive food stamps and reside in low income apartments. THe apartments are safe, well kept and clean. My ex husband owns a home.

Is it possible the court would take away my child on the grounds of my being poor? My child is happy and well adjusted. My child is never hungry, well clothed, etc.

Re: Child Custody and Disability

The only grounds would be if your level of income was detremental to the child by denying him or her opportunities that the Court deems important.
