my fiance is going through a custody battle abd her exhusbands lawer has called atleast one of her witness's and asked what the content of that witness's testimony will be

That's why lawyers have to exchange witness list before trial.

There's a potential upside. The opposing lawyer might find the potential testimony damaging enough they might just settle.
