Legal Question in Family Law in Pennsylvania

Child Custody

My husband and his ex-wife have joint legal and physical custody of their child who is now 11 years old. The mother has not had any contact with the child for over a year. We want to pursuu full custody. We have no idea where the mother is, she has moved out of the state from what we have heard. She has not had contact with us either. What are our options? We reside in PA and the custody agreement states that the oarents must stay in the state.

Re: Child Custody

Well if you want to pay me a lot of money to track her down it could be arranged.

As you effectively have full custody, a costly custody action seems not to be in the best interest of the child. The money could be better spent on the child.

Actually the custody order can't forbid either parent to move out of state, that's unconstitutional. What it most likely says is that if the custodial parent moves out of state the non-custodial parent can ask for a hearing to prevent the move.

If you have any questions feel free to contact me. The initial consultation is free.
